Plain-language disclosure
How Instant Compliance works, and what stays your responsibility
Instant Compliance is software. It gives you tools to help prepare, record and manage parts of your AML/CTF program. It does not provide legal or compliance advice, it does not guarantee compliance, and it is not affiliated with or endorsed by AUSTRAC. This page sets out exactly what the software does, what remains your responsibility, where it depends on others, and what it costs.
What the software does
Risk assessment questionnaire
A guided questionnaire about your business. From your answers it produces a draft risk assessment document that you review, edit and approve.
AML/CTF program document generator
Generates a draft AML/CTF program document from templates and the details you enter. It is a starting point. You must review it, tailor it to your business, have it approved and keep it current.
Customer checks (KYC / KYB)
Sends identity-verification requests to your customers through our third-party verification provider and returns the results, together with PEP, sanctions and adverse-media screening matches, for your compliance officer to review. The software does not decide whether to accept a customer. You do.
Transaction records and monitoring
Lets you record transactions and applies rules you can configure to flag indicators for your review. Whether a transaction is suspicious is your judgement.
Reporting
Helps you prepare the content of reports (such as suspicious matter and threshold transaction reports). Your compliance officer reviews and lodges reports with AUSTRAC. The software does not lodge anything without your action.
Training
Provides training modules and records who has completed them. Deciding what training your staff need, and making sure they do it, remains yours.
Records and audit log
Stores the documents and actions recorded in the platform with timestamps, to help you evidence your work.
What stays your responsibility
The law places AML/CTF obligations on your business, not on your software. Using Instant Compliance does not transfer any of them. In particular, you remain responsible for:
- Determining whether your business is a reporting entity and which designated services it provides.
- Enrolling with AUSTRAC and meeting any registration requirements.
- Appointing a compliance officer and setting your governance arrangements.
- Reviewing, tailoring, approving and adopting your AML/CTF program document, and keeping it current as your business, the law and regulatory guidance change.
- Making every risk decision: customer risk ratings, enhanced due diligence, and whether to onboard, retain or exit a customer.
- Reviewing verification and screening results and deciding what to do about them.
- Deciding whether a matter is reportable, and lodging any report within the required timeframe.
- Completing staff training and keeping it up to date.
- Ongoing customer due diligence, transaction monitoring and periodic reviews.
- Arranging any independent review your program requires.
- Retaining records for the periods the law requires.
- Obtaining legal or compliance advice where you need it.
Limitations
- Instant Compliance is software. It does not provide legal, regulatory or compliance advice, and nothing on this website or in the platform is advice.
- Using the software does not guarantee compliance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act), and does not guarantee any outcome with AUSTRAC.
- Generated documents are drafts based on templates and your inputs. They may not address every requirement that applies to your business.
- Verification, screening and registry results come from third-party sources and may be incomplete, out of date or wrong. You must apply your own judgement.
- We do not promise a set-up time. How long it takes to establish and run your program depends on your business.
- Our support team can help you use the software. They cannot tell you how the law applies to your business.
What the software depends on
- A third-party identity-verification provider (currently Sumsub) for document and biometric checks.
- Company and beneficial-ownership registries (for example ASIC), and sanctions and PEP list providers.
- AUSTRAC Online for enrolment and report lodgement.
- Cloud hosting and the other sub-processors listed on our Trust page.
- The accuracy of the information you and your customers enter, your own systems, and internet access.
Our sub-processors and where data is hosted are listed on our Trust page.
